1. Acceptance of Terms

By accessing or using CreateFame (“we,” “our,” or “us”), you agree to these Terms of Service.
If you do not agree, do not use the platform.

2. Eligibility

• You must be 18 years or older to create an account and use CreateFame.

• By registering, you confirm that you have the legal capacity to enter into this agreement.

3. Accounts & Security

• You must provide accurate and complete account information.

• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• Notify us immediately at info@barrierebrekers.nl if you suspect unauthorized use of your account.

4. Services Provided

CreateFame provides tools to:

• Generate written and visual social-media content using AI services.

• Connect and post to third-party social-media platforms on your behalf.

• Store and schedule your content.

We may update or modify the features at any time without prior notice.

5. User-Generated Content

• You retain ownership of any content you create or upload to CreateFame.

• You grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for providing our services.

• You are solely responsible for the legality, reliability, and appropriateness of your content.

6. Third-Party Integrations

• When you connect your social-media accounts, you authorize CreateFame to access those accounts and post content on your behalf.

• We use third-party APIs and AI tools; your use of these features is also governed by the terms and policies of those third parties.

• We are not responsible for any changes, restrictions, or failures in third-party platforms.

7. Payments & Billing

• Certain features require a paid subscription.

• By subscribing, you agree to pay the fees shown at checkout.

• Payments are processed by third-party payment processors.

• Fees are non-refundable except where required by law.

8. Prohibited Activities

You agree not to:

• Use CreateFame for unlawful, harmful, or deceptive purposes.

• Violate the terms of connected social-media platforms.

• Upload or generate content that is illegal, defamatory, discriminatory, infringing, or otherwise violates rights of others.

• Attempt to reverse-engineer, disrupt, or misuse the platform.

We reserve the right to suspend or terminate accounts that violate these rules.

9. Data Protection & Privacy

Your use of CreateFame is also governed by our Privacy Policy and Data Deletion Policy, which describe how we collect, use, and protect your data.

10. Service Availability & Disclaimers

• We strive to keep the platform available and functioning but do not guarantee uninterrupted or error-free service.

• The service is provided “as is” and “as available” without warranties of any kind, express or implied.

• AI-generated content may not always be accurate or appropriate; you are responsible for reviewing it before publishing.

11. Limitation of Liability

To the maximum extent permitted by law:

• Barrière Brekers B.V. and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from your use of CreateFame.

• Our total liability for any claim shall not exceed the amount you paid for the service in the past 12 months.

12. Termination

• You may cancel your account at any time through the app or by emailing info@barrierebrekers.nl.

• We may suspend or terminate your access if you breach these Terms or use the service unlawfully.

• Upon termination, your access ceases and your data will be handled according to our Data Deletion Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands.
Disputes will be submitted to the competent courts of the Netherlands.

14. Changes to These Terms

We may update these Terms from time to time.
Changes take effect upon posting the revised version in the app.
If you continue to use CreateFame after changes are posted, you accept the updated Terms.
